These terms and conditions govern your use of www.thewellyshop.com and the purchase of any products from The Welly Shop. By using our website or placing an order, you agree to these terms.
1. About us
www.thewellyshop.com is operated by The Welly Shop, a UK-based retailer of wellington boots. References to "we", "us", and "our" mean The Welly Shop.
2. Placing an order
When you place an order, you are making an offer to buy the products in your basket. We will send you an order acknowledgement by email, but a contract between us is only formed when we send you a dispatch confirmation. We reserve the right to refuse or cancel any order, for example if a product is out of stock, incorrectly priced, or if we suspect fraudulent activity.
3. Pricing and payment
- All prices are shown in pounds sterling (GBP) and include VAT where applicable.
- Delivery charges are shown separately at checkout before you confirm your order.
- We accept payment by card (via Stripe) and PayPal. Payment is taken in accordance with each provider’s terms.
- While we take care to price products correctly, errors may occur. If we discover an error in the price of goods you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel the order.
4. Delivery
We aim to dispatch orders promptly and deliver within the estimated timeframe shown at checkout. Delivery times are estimates and not guaranteed. Risk in the goods passes to you on delivery. For full details, please see our Delivery Information page.
5. Your right to cancel and returns
If you are a consumer, you have the right to cancel your order within 14 days of receiving the goods under the Consumer Contracts Regulations 2013, without giving a reason. To exercise this right, contact us and return the goods unworn and in their original condition and packaging within 14 days of notifying us.
If you cancel and return your whole order within 14 days of delivery, we refund the delivery you paid up to the cost of our standard delivery option. Any additional amount paid for a faster delivery option is not refunded. For returns made more than 14 days after delivery, which we accept as a goodwill policy beyond your statutory rights, we refund the goods but not delivery.
Free delivery applies to the goods you keep. If you return part of an order that qualified for free delivery and the goods you keep are then below the free delivery threshold, we will deduct the standard delivery charge from your refund. We do not deduct anything when you return the whole order.
None of the above limits your rights for faulty or misdescribed goods: in those cases we refund delivery in full and make no deduction.
Certain items may be excluded where permitted by law. This does not affect your statutory rights in respect of faulty or misdescribed goods. For how to return an item, see our Returns & Exchanges page.
6. Faulty goods
Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality, and fit for purpose. If a product you receive is faulty, please contact us and we will arrange a repair, replacement, or refund as appropriate.
7. Product information
We take care to describe and picture our products accurately. However, colours may vary depending on your device’s display, and sizing can vary between brands. Please refer to our Size Guide before ordering. Product images are for illustration and may differ slightly from the item supplied.
8. Your account
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately if you believe your account has been used without your authorisation.
9. Acceptable use
You agree not to use our website in any way that is unlawful, that could damage or disrupt the site, or that infringes the rights of others. We may suspend or withdraw access to our website at any time.
10. Intellectual property
All content on this website, including text, images, logos, and design, is owned by or licensed to The Welly Shop and is protected by intellectual property laws. You may not reproduce or use it without our written permission.
11. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under English law. Subject to that, we are not liable for losses that were not foreseeable or that arise from your failure to follow reasonable instructions.
12. Privacy
We process your personal data in accordance with our Privacy Policy and use cookies as described in our Cookie Policy.
13. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one published on our website at the time you place it.
14. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
